Terms & Conditions — Obscure Vibrations

These Terms and Conditions apply to all services and digital products provided by Obscure Vibrations, registered in Hasselt (3500), Belgium, operating as a company under the VAT number BE0876478439 through Starterslabo.
By requesting or purchasing services or digital products from Obscure Vibrations, the client acknowledges that they have read, understood and agreed to these terms.

 

1. Services Offered

Obscure Vibrations provides the following services:

• Audio mixing
• Mastering
• Custom sound design for video, music or artistic projects
• Preset packs and sample packs sold via the webshop

Service-based projects (mixing, mastering, custom sound design) require initial contact through the website form or email. A written invoice will be provided before any work begins. Digital products purchased through the webshop are delivered immediately by download and do not require direct contact.

 

2. Pricing & Payment

Service-based projects

• First consultation call is free.
• A 50% deposit of the total price is required before work begins.
• The remaining 50% balance is due before final delivery of the finished work.
• Payment method: bank transfer only.
• Currency: EUR (€).
• Work will not be delivered until full payment is received.
• No late-payment fees apply, as payment in full is required before delivery.

Preset & sample packs

• Purchased through the webshop and paid in full at checkout.
• Delivered immediately through digital download.

 

3. Revisions & Feedback

• Initial stage (first contact + early versions): 4 revisions included.
• After the initial stage: 2 additional revisions included.
• Additional revisions beyond the included amount may incur an extra fee agreed between parties before work continues.
• Feedback must be provided via email at info@obscurevibrations.com.

 

4. Delivery Time

Delivery timelines depend on workload and project scope and will be agreed during the initial contact phase and communicated clearly. No fixed standard turnaround applies.

 

5. Cancellations & Refunds

Services (mixing, mastering & custom sound design)

• If the client cancels before work begins: the 50% deposit is non-refundable.
• If the client cancels after work has started: the deposit remains fully retained and no refund is issued.

Preset & sample packs

• If compatibility issues occur with the client’s software version, the client must contact info@obscurevibrations.com to attempt a technical solution.
• If no solution can be provided and proof of incompatibility is submitted, a refund is possible.

Provider-initiated cancellation

Obscure Vibrations may cancel a project (without refund of any deposit paid) if:

• The client becomes uncooperative, disrespectful, or stops responding,
• The requirements change substantially without agreement,
• Full refund is possible if the project scope becomes impossible due to reasons beyond control.

 

6. Intellectual Property & Usage Rights

Mixing & mastering

• The client becomes the full owner of the final audio upon full payment.
• The work may not be released, commercially distributed or uploaded before full payment has been made.

Preset & sample packs

• Royalty-free usage is granted to the buyer.
• Obscure Vibrations retains full ownership and may continue selling the packs.
• For custom sound packs created for sound labels, full rights may be transferred only via a written invoice and payment. Attribution must remain visible and credited to Obscure Vibrations.

 

7. Portfolio Use

Obscure Vibrations may publicly showcase and publish completed work for promotional purposes, including but not limited to website, social media, and portfolio, including visible display of the artist’s name.
If confidentiality is required, the client must request this before work begins.

 

8. Confidentiality

All discussions, private materials and unreleased audio shared by clients are treated as confidential and will not be shared without permission.

 

9. Liability

Obscure Vibrations is not responsible for:

• Client misuse of delivered files,
• Hardware or software problems on the client’s system,
• Lost data after delivery,
• Any damages resulting from delays caused by factors outside control.

For digital preset/sample products, if a product fails to operate due to compatibility issues, the refund conditions above apply.

 

10. Governing Law

These Terms are governed by Belgian law. 

 

11. Clients

Obscure Vibrations provides services to both individual artists and business clients internationally.
